  1. Introduction

    We are AlanHub Inc. (“AlanHub”) incorporated in the United States of America under company registration number 6380971. Our registered office is at 16192 Coastal Highway, Lewes, Sussex, 19958 Delaware, US. Our adress is 2200 Wilson Boulevard, Suite 320, Arlington, Virginia, 22201.

    AlanHub is organizing a free of charge thematic Photography Contest (the “Contest”) without the necessity of the purchase. The Contest is dedicated to 2020–2022 that has been full of catastrophic events – from COVID-19 to the war in Ukraine and the threat of a global nuclear war.

    The Contest is only accessible online and only via the following web page: https://contest.alanhub.com (the “Website”). AlanHub is providing access to the Contest subject to accepting these Terms and Conditions of Use (“Terms”).

    These Terms apply to the use of the Website and to the participation in the Contest, whether you (directly or indirectly) access it via mobile phone, computer, or any other device.

    Please review the following Terms with due care before you access/use the Website, and/or take part in the Contest, and/or submit the application via the application form. By accessing or using the Website, you confirm your agreement to these Terms. If you do not agree to these Terms, you may not access the Contest or use the Website.

    AlanHub may, at any time and without notice, terminate your access to this Website and Contest. If we do so, you do not have the right to bring any claim or claims against AlanHub.

  2. Terms Key Definitions

    • “We”, “us”, “our” or “ours” refers to AlanHub Inc.;
    • “You”, “yours”, “the participant” or “the applicant” refer to the person(s) using our Website and/or participating in the Contest;
    • “Work”, “work of art”, “photograph” or “photography” refer to the material submitted for the Contest entry by the participant.

  3. Consent to Terms and Conditions of Use

    By accessing the Website, and/or submitting an application and/or multiple applications through the Website you agree to these Terms and Conditions of Use (“Terms”). You agree to accept the Terms whether you submit an application with or without the intention to patriciate in the Contest. If you do not agree to be legally bound by all the Terms, please, do not access the Website and/or take part in the Contest.

    We will ask you to provide your consent to agree to these Terms. These Terms are effective as of the date shown at the top. We may change these Terms at any time without prior notice by posting an updated version on our website, so you may wish to check it before using this website and/or participating in the Contest.

  4. Contest Access

    The Website and the Contest can be accessed and used by residents of all countries.

    AlanHub makes no representations that the Contest, and/or Contest rules and limitations, and/or content in this Website are appropriate for use in all countries and jurisdictions. Participants who access the Website and participate in the Contest are solely responsible for compliance with local laws of the country where they take part in the Contest, including paying all taxes and duties, where it is required by law.

  5. Conditions of Participation

    Participation in the Contest is free. The applications are accepted only during the following period: from March 11, 2022 to December 15, 2022 23:59 (UTC-5). Entries submitted after December 15, 2022 may be disqualified and deleted by AlanHub. The participants must upload their Work(s) through the Website form only. Submitting the photograph(s) via the Website is the only way to take part in the Contest.

    By submitting your Work, you confirm and declare that the Work you are submitting is your own original Work created by you and/or your team members, and you have all necessary permissions and authorisations to submit the Work, including, but not limited to the occasions where the authorisation relating to certain elements of your Work is required to be obtained from the third party. Participants are solely responsible for any intellectual property rights infringements that might occur as a result of the Work submission and/or participation in the Contest, and/or all implications that occur as a result of participation.

    By submitting your Work, you warrant to AlanHub that the use of the Works or the Intellectual Property Rights in the Works by the AlanHub will not infringe the rights of any third party.

    The participant agrees to indemnify AlanHub and keep it indemnified at all times against all or any costs, claims, damages or expenses incurred by AlanHub, or for which AlanHub may become liable, with respect to any intellectual property infringement claim or other claim relating to the Works submitted by the participant as an entry to the Contest.

  6. Suitable Participants

    Participants must declare their official name and surname to participate in the Contest. The name and surname should be the same as on official documents, such as, for example, passport or driving license. This is required to protect you from unauthorized submissions, as well as to protect AlanHub from fraudulent and unauthorized entries.

    Entering inaccurate personal information and details may result in disqualification from the Contest and, as a result, refusal to issue monetary award/s in case your work wins.

    Participation in the Contest is open to all individuals above 18 years old regardless of their background or professional skills.

    AlanHub reserves the right to conduct all the necessary checks and due diligence and request the confirmation of the above when/if required.

    Members of AlanHub staff and judging panel are not allowed to participate in the Contest.

    Participants that, intentionally or unintentionally, do not comply with the rules will automatically be disqualified from the Contest and therefore their candidacy for the prize will be withdrawn.

  7. Suitable Photographs

    The Contest is dedicated to the years 2020-2022 that covers the catastrophic events – from COVID-19 to the war in Ukraine and the threat of a global nuclear war. The Contest is open to photographs taken during these three years - 2020-2022 and taken, mainly, after March 11, 2020. There are no restrictions on the photo content and photo technicality. AlanHub welcomes the submission of both professional and amateur photographs taken with the help of any suitable device.

    Photographs must be submitted in JPG or PNG formats and should be sized in at least 2000x2000 pixels. The maximum file size of a submitted photograph must be 100MB.

    The Works taken before March 11, 2020 or after December 15, 2022 may be disqualified and deleted by AlanHub. AlanHub reserves the right to conduct all the necessary checks and request the confirmation of the Work creation date.

  8. Participants Conduct

    Participants cannot submit the work that does not originate from them and/or does not belong to them. Participants cannot claim the ownership of work belonging to anyone else other than themselves.

    Participants must act with integrity, accuracy, and honesty. Any fraudulent actions and behaviours will result in disqualification and a lifetime ban on participants' engagement with AlanHub.

    AlanHub is not responsible for any violations resulting from the submission of the photograph and/or actions of the participant.

  9. Prohibited Use

    You may not use the Website and the Contest submission form for any of the following purposes:

    • in any way which causes, or may cause, damage to AlanHub or interferes with any other person’s use or engagement with AlanHub;
    • in any way which is harmful, unlawful, illegal, abusive, harassing, threatening or otherwise objectionable or in breach of any applicable law, regulation, governmental order;
    • making, transmitting or storing electronic copies of Content protected by copyright without the permission of the owner;
    • submit the materials and/or links with malicious content intended to damage or disrupt another user’s browser or computer;
    • submit the materials and/or links with malicious, pornographic, political, inappropriate and prohibited content.

  10. Results, Awards and Prizes

    The judging panel will vote for the photographs after the period during which the works are available for submission.

    The judging panel will select three winning photographs for each of the following six nominations:

    • The Best Fine-Art Photography;
    • The Best Documentary Photography;
    • The Best “Pain” Photo;
    • The Best “Hope” Photo;
    • The Best “Struggle” Photo;
    • The Best “Victory” Photo;

    The judging panel will also select one winning photograph for the Special Jury Prize.

    AlanHub may, at any time and without notice, change or adjust the titles and quantity of nominations if required.

    The judging panel will agree on the list of winning entries accordingly. The list of winning participants will be published on the Website, and the names of the participants will be disclosed to the public. By submitting your work to participate in the Contest, you give AlanHub your consent for your real name and residency to be published and disclosed.

    The Contest offers winning individuals the following monetary prizes:

      • The second prize of 2,000 USD
      • The third prize of 1,000 USD
    • The Best Documentary Photography
      • The first prize of 3,000 USD
      • The second prize of 2,000 USD
      • The third prize of 1,000 USD
    • The Best “Pain” Photo
      • The first prize of 3,000 USD
      • The second prize of 2,000 USD
      • The third prize of 1,000 USD
    • The Best “Hope” Photo
      • The first prize of 3,000 USD
      • The second prize of 2,000 USD
      • The third prize of 1,000 USD
    • The Best “Struggle” Photo
      • The first prize of 3,000 USD
      • The second prize of 2,000 USD
      • The third prize of 1,000 USD
    • The Best “Victory” Photo
      • The first prize of 3,000 USD
      • The second prize of 2,000 USD
      • The third prize of 1,000 USD
    • The Special Jury Prize – 5,000 USD.

    AlanHub reserves the right to change the prize and its value without any prior notice. AlanHub is not responsible for any taxes or duties that might occur is the result of processing the payment of the prize.

    The list of winners and winning photographs will be published on the Website within 7 (Seven) days after the end of the Contest.

  11. Notification of Finalists

    AlanHub will notify winners individually using the contact details provided by the Participants when submitting the Photographs. However, AlanHub highly recommends monitoring the Website from December 16, 2022 to December 22, 2022 in order to stay updated on the Contest outcomes.

    If your photograph has been listed/published as a winning work, and/or your name appears on the list of Contest winners, and you are not contacted by AlanHub Inc. you are advised to get in touch with AlanHub via the following email contest@alanhub.com. You may get in touch with AlanHub within 30 (Thirty) days after the results have been announced so that all required arrangements are to be made for you to receive the prize.

    This might mean that you will be asked to share your payment details so that the award can be paid directly to you. AlanHub may execute the payment of the award only to the Participant who submitted the Photography. The transfer of the award to the accounts of any other third party is not allowed

    You are responsible for notifying AlanHub of any changes in your name, and/or surname, and/or the email address. Where applicable, please direct the confirmation of changes to contest@alanhub.com. AlanHub reserves the right to request additional documents (either acting by itself or via the bank request procedure), including, but not limited to passport and/or utility bill.

    The processing of the award is executed in the US Dollars (“USD”) according to the amount specified in these Terms. In case the Participant does not have bank account in the USD the funds will be transferred to their account in any other currency. Winning participants are responsible for paying all taxes and duties including the exchange commissions and money transfer commission if this is required by local rules and laws.

    Winning participants are obliged to provide valid bank details opened in their names within 90 (Ninety) days after the results have been announced. Failure to do so might result in losing the right to claim the monetary prize.
    AlanHub reserves the right to disqualify the Participant from the Contest and, therefore, refuse to process the payment of the award without any further clarification in case these Terms have been infringed (intentionally or unintentionally).

    By participating in the Contest, you provide your consent for your name and/or photograph and/or country of residence and/or age to be published and made available to the public.

  12. Intellectual Property Rights

    AlanHub does not seek ownership over the works submitted to participate in the Contest, respects and supports the intellectual property rights of the participants. By taking part in the Contest, you declare the ownership of work submitted as written above, and AlanHub is entitled to use the work without obtaining any additional permissions and/or licences from you, your successors, associates and assigns, or any third parties, related or unrelated.

    By submitting your photograph and therefore entering the Contest, you agree to grant AlanHub, free of charge, the non-expiring irrevocable right to freely and limitlessly use the submitted photograph worldwide, including, but not limited to, the right to reproduce, distribute, sell, resell, adapt, adjust, edit, compile with other works, create collages, publish, adapt, copy, display or translate in printed or electronic media, use for charity purposes, even if they are not the winning entries.

    By submitting your photograph and therefore entering the Contest, you give AlanHub your non-expiring irrevocable consent to use, globally, fully, and/or partially, and/or in combination with other photographs or works, your photograph for all purposes, including, but not limited to promotional, publishing, marketing, advertising, and charity purposes, free of charge, without limitations and without obtaining any additional permissions and/or licences from you, your successors, associates and assigns, or any third parties, related or unrelated, even if they are not the winning entries. AlanHub, its’ successors, associates and assigns, may or may not attribute your name to the photograph in future

  13. Limitations of Liability

    AlanHub will not be liable to participants, its successors, associates and assigns, in respect of any losses arising out of events within and beyond our reasonable control. To the maximum extent permitted by law, AlanHub accepts no liability for any of the following:

    • Any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;
    • Loss or corruption of any data, database or software;
    • Any special, indirect or consequential loss or damage; and
    • Intellectual property rights breaches.

    AlanHub, its’ successors, associates and assigns are not liable to the participants for anything arising out of or in any way connected to the use of the Website, participation in the Contest, successful or unsuccessful entries, and anything else resulting from your interaction with AlanHub.

  14. Indemnities

    You agree that Alan Hub is fully and entirely indemnified from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable legal fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

  15. Severability

    AlanHub is not responsible for any circumstances and outcomes arising from force majeure as established by the local laws, or any events beyond its control, including, but not limited to the situations where AlanHub were to cancel the Contest.

  19. Entire Agreement

    These Terms are the entire agreement between AlanHub and you, and supersede any and all prior terms, conditions, warranties or representations to the fullest extent permitted by law.

  20. Applicable Law

    These Terms and Conditions of Use shall be governed by the law of England and courts of England and Wales will have exclusive jurisdiction in relation to these Terms.
